Deckers is an American corporation who obtained an international trademark for the Australian generic term "ugg" in the USA. Since this time Deckers has been continually attacking Australian companies who use their own term ugg. This means Australians can't sell products labeled "ugg" to people in about 130 countries.
Deckers has threatened legal action against almost all Australian ugg manufacturers, retailers, and marketers. Deckers has been reported to have threatened small companies with legal battles worth millions of dollars unless they stop using the term and agree to sign a non disclosure agreement to prevent bad press.
The Australian government has made it clear the "ugg" is a generic term and neither Australia nor New Zealand recognise the trademark.
Deckers is perhaps one of Australians most hated companies. It's actions are an insult to the Australian people and our culture.
In 2016 Deckers infers that any ugg sellers other than themselves are terrorists on their Counterfeit Education page.
One of the last remaining companies refusing to be defeated is Australian Leather, run by Eddie Oygur, has been in a legal battle with Deckers since their agents ordered 4 pairs of ugg boots from him and then sued him for infringement. Eddie lost the court case in the USA and also lost his appeal.
During the appeal hearing of which the recording can be found here, the USA court judges can be heard having a level of disbelief as to what Deckers had done, repeatedly asking what amounts to, "if you can't register a term of a foreign language to a category of the same product type, why do you think you can do it for a foreign country of English language?". Everyone felt that Eddie had finally won, alas we are told that the next the verdict had come out, Eddie had lost, without explanation.
People were in disbelief and asking how this was possible, why there was no reason given, was this corruption, doesn't a verdict usually take up to 30 days to come out.
Now Eddie is liable to pay [requires confirmation] roughly 3.2 million USD or 4 million Australian dollars.
Eddie is now preparing to bring this to the supreme court.
2021-07-14 The Ugg Association of Australia is formed to protect Australians and fight against Deckers unethical practices.
